This Privacy Policy (“Policy”) outlines how Smith Sport Optics Inc., (collectively “SMITH”, “we”, “our”, or “us”) uses, discloses and safeguard your personal data when you visit our site and our Imprint 3D products mobile app (referred to as the “App”).


This Policy, together with our Terms and Conditions, our Return Policy and any and all other applicable operating rules, policies, price schedules, and supplemental terms and conditions or documents that may be published from time to time, collectively govern your use of our sites.


Please note that this Policy applies only to our site and does not cover other sites that may be linked from our site. We encourage you to review the privacy policies of those sites independently.


We ask that you please read this Policy before using the site. It describes what information we gather from you and others who visit or use site, how we use that information, and how we do to protect it. When you access or use our site, certain information, including personal Information, may be collected, transferred, processed, stored, and in certain circumstances, disclosed or shared as described in this Policy.


Please note, by creating an account on our site or otherwise providing us with yours or others’ personal information, you expressly consent to the information handling practices described in this Policy and you acknowledge and confirm that you have permission to provide us with all personal information provided. If you do not agree with this Policy or our terms of use, please do not access, use, or register for an account on our site.

We may from time to time need to amend this Policy, due to changes in regulations and to keep up with new developments and possibilities on the Internet. We therefore reserve the right at our discretion to make these changes and ask you to check this page periodically, as you are bound by these changes when visiting our site. While we strive to keep the information on our site accurate and up to date, this does not guarantee the completeness, accuracy, or relevance of the content and will not be held responsible for any errors or omissions.

1.       WHAT INFORMATION DO WE COLLECT?

There are cases where we may ask you for PERSONAL INFORMATION which includes information about an identified or identifiable individual or household, subject to more definitions under applicable law.

When using our site, you may provide us with your personal information such CONTACT DATA as your name, alias, username, postal/billing address, day and moth of birth, gender, email address, telephone number, and ORDER INFORMATION as details of products or services ordered/purchased and requested and SOCIAL MEDIA DATA.

 

In some cases, in connection with certain services, we may collect certain additional information that is considered SENSITIVE INFORMATION such account data as payment card information and information related to your order of prescription lenses, and/or a face scan, which consists of a facial geometry scan.

 

We may collect precise geolocation data from you or your device, as well as your address information, e.g., shipping and billing address, when you set up your account and order our products or services. We also collect and use information about your general location (e.g., your state of residence) and can infer your approximate location based on your IP address to track our general site usage or to tailor any pertinent aspects of your user experience to the region where you are located.

 

We may display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, please refer to “How You Can Contact Us” section below.

 

In some cases, we might also collect personal information from you about a THIRD PARTY, including receiving personal information from data brokers. If you provide us with personal information about someone else, it is your responsibility to ensure that you have the necessary authority to do so, and that the individual has consented to our use of their information in accordance with this Policy.

Additionally, we may collect personal information about a third party from you, for example, if the site allows you to send an email referring someone to our site or a promotion. In such cases, we may require the recipient's name and email address solely for the purpose of delivering the email. We will not contact the third party further unless they initiate contact with us.

 

Most of this information is collected through your interactions with our site, such as when you create an account, subscribe to our newsletter, contact our customer service, download information, use our store locator or third-party sites and applications, complete a purchase or use our services, participate in our Custom Program for custom-made products, register for contests or promotions, or respond to communications such as emails. This also applies to services that require registration or subscription.

 

To enable us to understand your needs and to provide you with the best support and experience, we may collect, record, store, process and transfer your personal information that you have shared with us through chat sessions, contact forums, or other interactions on this site. By using this site, including the chat function, you consent to the recording, collection, storage and processing of your personal information and the contents of any chat or similar communications made through the site by us and our authorized third-party partners. Please know that we prioritize data security and maintain strict confidentiality measures to safeguard your information and will protect your data in accordance with our Policy. We inform you that at the bottom of each email you will have the possibility to revoke the registration to the service and stop receiving.

 

2.       NAVIGATION DATA

We may also collect personal/sensitive Information from third parties, such as social media including but not limited to Facebook®, Instagram®, Twitter®, Snapchat®, TikTok®, and YouTube® (collectively referred to as "Social Media"). This may include data from posts, comments, likes, or other forms of engagement with our content on these platforms. We may collect also personal/sensitive information from payment processors, product vendors, and other partners. This helps us improve the information’s overall accuracy and completeness and helps us better tailor our interactions with you.

 

When you visit our site, we may automatically collect certain technical information from your web browser, mobile, or other device when you visit the site. This data may include, but is not limited to, your IP address, browser type and language, referring/exit pages and URLs, other browser history, platform type, number of clicks, landing pages, the pages you requested and viewed, the amount of time spent on specific pages, and the date and time of your visits. Our collection of this data allows us to provide more personalized high-quality services to you and to track usage of the site.

3.       CHILDREN'S PRIVACY

We recognize the critical importance of safeguarding children's privacy, particularly in the online environment. Our site and services are not directed at or intended for use by individuals under the age of 16. We do not knowingly collect personal information from such individuals. If we become aware that we have inadvertently collected personal information from children under 16, we will take immediate steps to delete it from our systems. We strongly advise that individuals who are not of legal age in their jurisdiction refrain from accessing or using our services without the consent of a parent or guardian.


4.       HOW DO WE USE YOUR INFORMATION

4.1 Use of personal information

All personal information that we obtain about you will be collected, used and protected by us in accordance with current data protection legislation and this privacy Policy. We will primarily use your personal information to provide our service to you and in accordance with your choices and our internal business purposes, namely:

  • We will use information you provide as part of a transaction as necessary to process payments, and accept, process, and fulfill transactions.
  • We use registration information as necessary create and maintain accounts for registered users.
  • We use information provided in connection with a contest, promotion or survey as necessary to administer the contest, promotion, survey or other site  feature and to provide you with the relevant products or services (for instance to deliver a prize you may have won in a contest). You may be contacted by phone or email regarding the contest, promotion, or survey to the extent permitted by law.
  • If you opt-in or we are otherwise authorized to send you marketing communications, we will use your contact information as necessary to send you information/materials via e-mail or SMS-messages about products, offers and news we think could interest you. This information may relate to products, offers and news of Blenders Eyewear and/or its licensees or carefully selected commercial partners. We only send you this if you have opted-in to receive our e-mails and/or SMS messages. In case you do not want to receive any e-mails and/or SMS messages from us anymore, or if you want to modify your personal information or want your personal information to be deleted from our database, we refer you to the ' Your rights and choices regarding your Personal Information' section below
  • We use personal information collected automatically from the use of our Services to analyze visits to the service and learn about the interests of our visitors in aggregate and on an individual level to better understand your interests and preferences, so we can improve our products and services and deliver to you the type of content, features and promotions that you are most interested in.
  • To produce your order of prescription lenses and to deliver the products to you.
  • We may use any personal information to understand the performance of our service, improve our offerings, and for other internal purposes such as auditing or data analysis, service improvement, or for troubleshooting.
  • We may use any personal information to personalize our service, for example, aspects of the Service may be customized to you so that it displays your name or reflects your preferences, to display content or features that you have interacted with in the past, or to display material that we think may be of interest to you based on your interactions with our service.
  • We use information from communications with us to respond to inquiries and other requests.
  • We may use any personal information to investigate legal claims or comply with our legal obligations, protect individuals, employees, and our company, for loss prevention, and to prevent fraud or other unlawful activity.

In addition to the measures above, we may use your personal information for other purposes for which we have obtained your consent, and for such other purposes as may be permitted or required by applicable law.


4.2 Use of sensitive personal information

We take specific measures when we process sensitive personal information, namely:

a.         When you provide prescription information, we use your prescription only with your consent, for the purpose of creating custom products specific to your prescription, and as otherwise necessary to provide our product or service. Prescription information will not be used in connection with any user or consumer profiling and will not be disclosed or disseminated to a third party and will be kept private unless requested otherwise.

b.         When you use our virtual try on experiences, we may collect data that potentially may be considered “Sensitive Personal Information” or may falls under the definitions of “biometric identifiers” or “biometric information” under applicable law

Any collection of “Sensitive Personal Information”, “biometric identifiers” and “biometric information” are for the sole purpose of assisting you in viewing how certain eyeglasses may look on your facial features. We will not disclose or disseminate any biometric information to any entity, other than those contracted parties that assist us in providing this service to you, or as required by applicable federal, state or local law, or required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.

Before using our virtual technology features, you will be prompted with a copy of this policy. By clicking “I accept” you are consenting to our collection of your Sensitive Personal Information, biometric identifiers or biometric information.

c.         When you use Smith Optics Imprint 3D Mobile App: If you choose to participate in our Smith custom made products program, upon purchase on our site and through download of our Smith mobile application (“App”), you will be asked, upon your consent, to perform and upload a face scan to receive custom made products. We will obtain facial geometry through your uploaded face scan to build your requested custom fit goggles. This information may be considered “Sensitive Personal Information” or “biometric identifiers” and “biometric information” under applicable law.

  • Prior to submitting the face scan, you must consent to allow us to obtain your information and store and utilize the information for the sole purpose of generating and delivering your requested custom-made products. Smith’s App utilizes software to capture the contours of your face, create a custom goggle model to your face shape, and then 3D prints a custom goggle to the contours of your captured face scan. To protect your information and comply with various laws governing information, Smith has implemented the following specific policies:
  • Smith Optics creates, stores, and utilizes your face scan for the sole purpose of generating and delivering the Smith Optics Imprint 3D products which you have ordered.
  • You must first consent to our Policy outlining our collection, storage and use of your face scan (there is no disclosure of your face scan, only a disclosure of your Imprint 3D goggle model, generated internally based off your face scan) before you are able to upload your face scan to our Imprint 3D database
  • There is no disclosure of your face scan. Our systems generate a custom goggle model based on your submitted face scan. The generated custom goggle model is what is disclosed to create your Smith Imprint 3D products. Smith will not sell, lease, trade or otherwise profit from your face scan.
  • Smith Optics will not disclose or disseminate your face scan, or your custom goggle model, for purposes other than to provide Smith Imprint 3D products.
  • Once captured, face scans are encrypted and stored by Smith on our secure server storage system. Service providers are contractually required to store this type of information, such as your face scan, using appropriate security measures.
  •  Smith will retain your face scan for the time necessary to manufacture your custom-made product and in any case no longer than six (6) months from the date of collection and thereafter will permanently destroy your face scan from our systems. You may revoke your consent to the processing of this Information at any time. 

4.3. Retention of Personal Information

We will use, disclose or retain your personal information only for as long as necessary to fulfill the purposes for which that personal information was collected and as permitted or required by law. If you would like further information regarding the periods for which your personal information will be retained, please contact us as set forth in the “How You Can Contact Us” section below. We will review retention periods periodically, and if appropriate, we may pseudonymize or anonymize data held for longer periods.

 

4.4 Protection of visitors' information

In order to protect the information, you provide to us by visiting our service, we have implemented commercially reasonable security measures designed to protect your personal information from loss or theft, unauthorized access, disclosure, copying, use, deletion, or modification.


Please keep in mind though that whenever you give out personal information online there is a risk that third parties may intercept and use that information. While we strive to protect its user's personal information and privacy, we cannot guarantee the security of any information you disclose online, and you do so at your own risk. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any information that you provided to us has been compromised), please contact us immediately using the contact information in the “How You Can Contact Us” section below.

 

4.5 Disclosing personal information to third parties

We may use and disclose your information when we believe such use or disclosure is permitted, necessary or appropriate: (a) under applicable law, which may include laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce the terms of the agreements for our Services and products; (e) to protect our operations or those of any of our affiliates or subsidiaries; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. In addition, we may transfer your personal information and other information to a third party in the event of any actual or (subject to certain confidentiality restrictions) prospective reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, brands, affiliates, subsidiaries or other assets.


Your data may also be transferred to sites hosting partners, CRM providers, and other parties who perform services on our behalf, for instance prize or order fulfillment or to help us analyze data.


These parties will only use your data for the purpose of performing services on our behalf and are generally required to protect personal information consistent with our obligations under applicable law. We take reasonable measures to ensure that the rules set forth in this Policy are complied with and these third parties provide sufficient guarantees to implement appropriate security measures. When our service providers no longer need your personal information for those limited purposes, we require that they dispose of the personal information. In some circumstances, we may permit our service providers to retain aggregated, anonymized or statistical information that does not identify you. We do not authorize the service providers to disclose your personal information to unauthorized parties or to use your personal information for their direct marketing purposes. If we otherwise intend to disclose your personal information to a third party in a manner not described in this Policy, we will identify that third party or the category of third parties (as appropriate) and the purpose for the disclosure and obtain your consent if required by applicable law. We will also release personal information without consent if such is required by law, for security purposes, or to prevent imminent harm.


4.6 Links to third parties and plug-in

For your convenience and to improve the usage of the service, our site may provide links to third-party sites or apps, including our social media pages to which this Policy does not apply. These links take you outside our service and off our site and are beyond our control. This includes links from partners that may use our logos as part of a co-branding agreement or sell our products. The sites you can link to have their own separate policies, and although we strive to protect the integrity of our service, we are not responsible and cannot be held liable for the content or activities of these third-party sites and services. Your visit/access to these sites is therefore entirely at your own risk. Please note that these other sites may send their own cookies to users, collect data or solicit personal information on their sites and services. The site may also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share information or interact with social media features on the Platforms, those social media companies may collect information about you and may use and share such information in accordance with their own policies, including by sharing such information with us or the public. Your interactions with third-party social media companies and the use of their features are governed by the privacy policies of the companies that provide those features. 4.7 Use of cookies and Automatic Information Gathering Technologies

Every time you use this site (e.g., access a webpage, or navigate to a specific location within the site), we collect personal data (as discussed above) and non-personal data (i.e., information that does not personally identify an individual) regarding that use. For example, to improve our site, we collect how, when, and which parts of the site or their features you use. Also, we may use your device’s unique identifier (UDID) or other unique identifiers to assist us in collecting and analyzing this data. To assist us in collecting and storing this non-personal data, we may employ a variety of technologies, including “Cookies,” local browser storage, and “web beacons,” “pixels,” or “tags.” A cookie is a small file stored in your browser that contains information that sites use to identify users and store other information about the use of a site. You can decide not to activate cookies and similar technologies, notably those used for geolocation and profiling purposes, in case you prefer not to receive them. To the extent required by applicable law, and subject to our rights to limit or deny access/disclosure as permitted under such law, you have the following rights regarding your personal information. All requests to exercise these rights are subject to appropriate identity verification, as required by law. ·     You may cancel your registration at any time, and you may choose to opt-out of receiving any e-mails from us,

·     You may have the right to access or modify your personal information. We encourage you promptly to update your personal information if it changes.

·     You have the right withdraw your consent to the disclosure or use of any other data we have (including face scan and try on services) to the extent we rely on your consent. 

·     You may have the right to request to have your personal information deleted from our database (subject to appropriate limitations under applicable law).

·     Under certain circumstances, you may have the right to request information about the use of any automated decision system and the impact they may have on you

·     You may have the right to request will send you a copy of your personal information in a common portable format of our choice.

·     You may have the right to opt out of the sale or sharing of data, subject to the limitations and requirements of applicable law.

If you do not want information collected through the use of cookies, you can manage/deny cookies (and certain technologies) using your browser’s settings menu, or through tools or interfaces that allow for the management of cookies and similar technology that we may make available on the service from time to time. You may be required to opt out of third-party services directly via the third party. 6.        NOTICE TO USERS OUTSIDE THE UNITED STATES

Please be aware that the Service and the information collected, are managed and controlled by us and our service is provided from the USA. If you are located outside the USA and/or if you are using any of our products or services from outside of the USA, your information may be transferred to, stored, and processed in the United States where our servers may be located and by submitting the information you authorize this transfer. While such information is outside of your country of residence, it is subject to the laws of the country in which it is located, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. The USA may not offer the same level of privacy protection as the country where you reside or are a citizen.


By using the site, communicating with us via mail, email or telephone, or otherwise providing information to us, you consent to the transfer to, and processing of, your information in the USA in accordance with this Policy.

Depending on the state in which you reside, you may have certain privacy rights regarding your personal data. In addition to California residents, consumers in other states, including Colorado, Connecticut, Illinois, Nevada, Oregon, Texas, Utah and Virginia, may have similar rights concerning their personal information. These rights may include the right to access, correct, obtain a copy, delete, disclosures and opt out of the sale or sharing of personal information, as well as opt-out rights related to targeted advertising and profiling. 8.       NOTICE TO CALIFORNIA RESIDENTS

We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), the California Privacy Rights Act of 2020 (CPRA), and any other California privacy laws. Any terms defined in the CCPA/CPRA have the same meaning when used in this section.

 

Under the CCPA/CPRA, California residents have specific rights regarding their personal information. These include the right to:

-             Access the categories and specific pieces of personal information we have collected about you

-             Delete certain personal information we have collected from you

-             Correct inaccuracies in your personal information

-             Opt-Out of the sale or sharing of your personal information, if applicable

-             Limit the use of sensitive personal information (such as precise geolocation data) in certain contexts

We do not sell your personal information in exchange for monetary consideration. However, our site may use certain third-party services (such as advertising and analytics partners) that may involve the "sharing" of your personal information as defined under the CPRA.
